These Terms of Business explain how we provide our services and what you can expect when arranging a funeral with us.

Introduction

We understand that arranging a funeral can be a difficult and emotional time. Our aim is to support you with care, clarity, and professionalism throughout.

These terms set out how we will work with you. By asking us to proceed with arrangements, you are agreeing to these Terms of Business.

These terms are governed by the law of Scotland and comply with relevant UK and Scottish legislation.

Our Services

We will carry out all services with reasonable care and skill, and in line with your wishes.

We will discuss and confirm all arrangements with you in advance, and provide written details of the services we will deliver.

Estimates and Charges

We will give you a clear written estimate covering:

  • our professional services, and
  • any third-party costs (known as disbursements), such as crematorium, burial, or minister’s fees.

We will clearly distinguish between our professional fees and third-party costs within your estimate.

While we always aim to be accurate, some third-party costs may change and are outside our control. If this happens, we will let you know as soon as possible before any additional costs are incurred.

Payment Terms

We may ask for a deposit of up to 50% of the estimated total cost before the funeral takes place.

The remaining balance is due within 14 days of the date of our invoice. 

If payment becomes overdue, we may charge interest at 1.5% above the Bank of England base rate, calculated daily, in line with UK legislation.

We may also recover any reasonable costs incurred in recovering overdue payments.
If you have any concerns about payment, please speak to us — we will always try to help where we can.

Cancellation and Changes

You have the right to cancel this contract within 14 days of entering into it, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you ask us to begin arrangements within this period, you may need to pay for any work already carried out and any costs we have incurred up to the point of cancellation.

If the funeral has already taken place, or services have been fully provided, cancellation rights will no longer apply.

Data Protection

We take your privacy seriously.

We will handle your personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We use your information to:

  • arrange and carry out funeral services
  • communicate with you
  • meet our legal and regulatory responsibilities

This may include sensitive personal information where it is necessary to carry out funeral arrangements.

We only keep your data for as long as necessary. You have the right to access, correct, or request deletion of your data, where appropriate.

You also have the right to raise concerns with the Information Commissioner’s Office (ICO).

Complaints

We are committed to providing a high standard of care and service.

If something is not as you expected, please let us know as soon as possible.

If you wish to make a complaint, you can contact us by phone, email, or in writing. We will acknowledge your complaint and aim to resolve it promptly, fairly, and in a respectful manner.

If we are unable to resolve your concern, you may refer the matter to the National Association of Funeral Directors (NAFD), of which we are a member, in accordance with their Code of Practice.

Limitation of Liability

We will always do our best to deliver services as agreed. However, we cannot be responsible for delays or issues caused by circumstances beyond our reasonable control.

Nothing in these terms limits liability for death or personal injury caused by negligence, or for anything that cannot legally be excluded under Scots law.

Otherwise, our liability is limited to the value of the services we have provided.

Third-Party Services

Some parts of the funeral are provided by third parties (for example crematoria, cemeteries, ministers, or florists).

We act as your agent when arranging these services on your behalf. While we take care in selecting providers, we cannot be responsible for their performance.

Governing Law

These Terms of Business are governed by the law of Scotland, and any disputes will be dealt with by the Scottish courts.
